Get the D40. It will be all the camera you need and then some! It should last you for a long time to come, and when you have developed skills beyond it, it will still be a nice small and light camera to carry around on family day-tris or whatever.

I don't see anything unfair about the policy.
I work in construction and when we return materials to a wholesaler, there is always a 15-25% restocking fee.
Plus it's not a bad price to pay to rent you stuff for a weekend or whatever.
I wouldnt count on the long-term durability of 1/8" aluminum vibrating around on the back of a bike, but ya never know. It's cheap enough to give it a whirl.
